After a motorcycle crash where the at-fault vehicle can’t be identified (hit-and-run), you may sue the Insurance Commission of Western Australia (ICWA) directly and recover what you could have from the unknown driver—so long as you made due search and inquiry to identify the vehicle and gave ICWA written notice “as soon as practicable” after the crash, setting out the grounds of your claim (Motor Vehicle (Third Party Insurance) Act 1943, s 7(3)).

If the at-fault vehicle was uninsured, and you obtain a judgment against the owner/driver that isn’t paid within one month, you can claim the unpaid balance (up to policy limits) from ICWA (s 8(1)). Where the owner/driver is dead or can’t be found despite strict inquiry, you may take proceedings directly against ICWA (s 8(5)–(7)).

In all cases you must give ICWA written notice of your intention to claim “as soon as practicable” after the accident or you cannot commence/maintain the damages action (s 29(1)). Act quickly: report to police, preserve evidence (helmet/gear, dash-cam/CCTV), get medical care, and seek advice—court proceedings generally must start within 3 years of the crash.

There’s no fixed timeline—your motorcycle claim moves as fast as your medical recovery and evidence allow. ICWA usually won’t discuss full settlement until your injuries are medically stable (your doctors can reliably say what’s permanent and what future treatment/work limits you’ll have).
