Who counts as a "close tie" for a nervous shock claim?

The following answer applies to a common law negligence claim. To claim in WA, you must show:

  2. It was reasonably foreseeable that a person of normal resilience might suffer that illness if the defendant didn’t take reasonable care.

Parents let their 16-year-old work on a remote station after the employer promised close supervision. The boy went missing and was later found dead. The parents developed psychiatric illness. The High Court held the employer owed a duty of care for mental harm: given the promises, the risks, and the parents’ obvious vulnerability, it was foreseeable they could suffer serious psychiatric injury if things went wrong. The Court rejected strict rules like requiring a sudden shock or being at the scene.

Do you have to know the defendant?

No. Knowing the defendant is not a legal requirement. A pre-existing relationship (e.g., employer–parent, doctor–patient) can make the duty clearer, but strangers (e.g., a careless driver) may also owe a duty if psychiatric harm was foreseeable.

There is case law to the effect that an employer owes a duty to take care to protect from psychiatric harm all those persons that it knows or ought to know are in a close and loving relationship with its employee. It is not a condition of that duty that such persons should be present when the employee suffers harm or that they should see the injury to the employee.

Do I have to see the accident happen to claim?

Direct perception of an incident or its aftermath is not in all cases a necessary aspect of a claim for damages for negligently inflicted psychiatric injury.

In some cases, a person making a claim will witness the immediate aftermath of an accident, for instance, following a fatal motor vehicle accident a person sees a dead body inside one of the vehicles involved. Witnessing the “immediate aftermath” can also be sufficient.

What diagnosis do I need for a claim?

You need a formal diagnosis of a recognised psychiatric illness, like PTSD or major depressive disorder, from a qualified medical professional such as a psychiatrist or general practitioner. An opinion from a clinical psychologist may also be successful.
