Am I eligible for an RSI claim in WA?

  • No-fault scheme: You don’t need to prove your employer was negligent to make a WorkCover soft tissue injury claim. If work materially contributed to a gradual-onset injury (WorkCover WA), you may be entitled to compensation.
  • What counts as RSI/overuse: Common claims include tendinopathy, epicondylitis (“tennis elbow”), tenosynovitis, myofascial pain, and other musculoskeletal conditions from repetitive or sustained tasks.

Tip: If your injury built up over time across multiple jobs (multi-employer exposure), we can still help. Keep a simple duties log; we’ll map exposure to each employer.

The evidence that proves an RSI (and speeds up approval)

Your proof pack:

  • Duties & rotation logs (task frequency, weights, keyboard/keystroke or pick-rate metrics)
  • Workstation photos/videos (posture, reach, repetition)
  • Symptom diary (when pain flares relative to tasks)
  • Clinical Framework treatment plan (GP/physio notes linking duties → symptoms, graded activity goals)
  • Ergonomic assessment (WA) or Workplace Rehabilitation Provider (WA) report
  • Functional Capacity Evaluation (WA) if needed for capacity clarity or RTW planning.

Bring your evidence to your consultation with one of the specialist RSI lawyers. We’ll convert it into a clear causation narrative for the insurer.

Return to work (RTW) & suitable duties in WA

  • Your employer must implement an approved Return to Work program (WA) when your doctor indicates partial capacity.
  • We help you secure suitable duties (WA) that match your Certificate of Capacity and keep your recovery on track.
  • Expect things like task rotation, shorter shifts, alternative roles, or extra rest breaks — documented in the approved form.
  • We can also request a return to work case conference (WA) with your treating team if needed.

Injury management system (WA): Good employers have one. If you’re not seeing a plan, we’ll prompt the right steps and involve a Workplace Rehabilitation Provider (WA) where appropriate.

Soft Tissue & Overuse RSI in Western Australia – FAQ

Is gradual-onset RSI covered in WA?

Yes — WA is a no-fault system. If work contributed, you can claim.

How long does a decision take?

Employer 7 days to lodge; insurer 14 days to decide (or defer). If no notice in 14 days, your claim is taken-to-be-accepted

What are “suitable duties”?

Duties/hours that fit your current capacity, set out in an approved RTW program.

When does WPI apply?

After your injury stabilises. You will need to undergo assessment by an Approved Permanent Impairment Assessor (WA)

Can I claim workers compensation for a gradual-onset RSI or soft tissue injury at work in WA?

Yes—if you develop repetitive strain injuries, tendinopathy, tenosynovitis, or other soft tissue conditions from your normal work tasks, you are covered under WA’s no-fault WorkCover scheme. You don’t need to prove employer negligence; just show your job caused or significantly contributed to the RSI.

Common claim examples include warehouse picking, office keyboard use, healthcare manual handling, or retail checkout strain.

Start with a First Certificate of Capacity and complete the Workers’ Compensation Claim Form. RSI claims are often not accepted by the workers compensation insurer. We can help you to go through the WorkCover WA process to get your claim accepted or to get a settlement.

Can I claim Public Liability compensation for a soft tissue or RSI injury?

You can claim compensation if the actions of a person or company other than your employer caused your injury. These claims are most commonly seen against ‘host employers’ or in other words a company in control of a person’s work but that company is not their employer.

Can I claim compensation for an RSI or soft tissue injury caused or worsened by a motor vehicle accident in WA?

This would be unusual. Most most vehicle claims are from a specific event. Sometimes a person has an RSI and then after a motor vehicle accident their repetitive strain injury became worse or where ongoing soft tissue pain develops over time due to chronic driving and vibration exposure. Most MVA claims focus on single-event injuries (like whiplash or trauma), not gradual-onset RSI. If you’re unsure, use Foyle Legal’s RSI Claim Check for tailored advice.

Can RSI or soft tissue injuries qualify me for TPD superannuation claims in WA?

Yes—if your RSI or soft tissue condition is so severe that you can never return to any paid work for which you’re qualified by education or experience, you may qualify for a TPD lump sum through your superannuation policy. Examples include severe tendinopathy, epicondylitis, or multiple failed surgeries leading to permanent impairment. We help you gather the evidence to support your claim and deal with super funds and their insurer directly.
