Notice of a claim needs to be given to ICWA as soon as practicable after the occurrence giving rise to the claim by giving them a notice of intention to make claim form (see Section 29, Motor Vehicle (Third Party Insurance) Act 1943). The limitation period for an injury claim is usually 3 years from the date of the accident.

Do I need scans for whiplash?

If your whiplash persists your doctor will usually request scans. These can be helpful but no finding on a scan does not mean you do not have a claim.

Can I claim if my neck pain started late?

If you have symptoms of personal injury you should complete a notice of intention to make claim form with the Insurance Commission of Western Australia.
