Will surgery for broken bones and fractures increase my whole person impairment (Workers Compensation)

Under WA workers compensation, your Whole Person Impairment (WPI) is generally assessed after you reach maximum medical improvement. Special assessments (which provide a WPI even if a person is not stabilised) can be undertaken 18 months after a claim is made. Some surgery for fractures (e.g. fusion operation and joint replacement) will result in an automatic increase in whole person impairment. For instance, if a person has not had any surgery for a lower back (lumbar spine) injury their whole person impairment will often be between 5% to 8%. If they have a fusion operation then their whole person impairment will be at least 20%. Other surgery can increase WPI when there are lasting, objective problems such as:

  • Loss of joint motion or stability
  • Malunion/non-union or hardware complications, revision surgery, or post-traumatic arthritis.
  • Structural change (fusion, joint replacement, limb-length discrepancy, deformity, or partial amputation).
  • Strength loss or tendon/muscle compromise affecting gait, grip, or lifting.
  • Nerve injury or pain syndromes and hypersensitivity.

If surgery has an excellent outcome with near-normal function, WPI may be low (though not with some conditions such as a fusion where WPI increase is automatic). To quantify your entitlement, you’ll need a permanent impairment assessment by an approved assessor using the WorkCover WA Guides.
