If liability or treatment is disputed, the matter goes through WorkCover WA conciliation, and if unresolved, to arbitration.

Permanent impairment (PI)L Once you’re medically stable, you can be assessed for permanent impairment. For any common law pathway, you must obtain a WPI from an Approved Permanent Impairment Assessor (APIA) and, if WPI ≥ 15%, make a common law election before the statutory termination date. (If WPI ≥ 25%, common law damages are uncapped—subject to court principles and offsets.)

Settlement. Many CRPS claims resolve by agreement—often after key medical evidence (including the APIA report) is in. Early, thorough medical documentation is critical to maximise treatment approvals and compensation.

What’s the ICWA process for nerve injury?

Make a claim with ICWA by completing the notice of intention to make claim form. Medical and financial evidence will be collected then most claims settle either at a settlement conference or through the District Court process.

How long do I have to claim?

You should make a claim for a motor vehicle accident injury claim as soon as practicable by completing the notice of intention to make claim form.
