Generally speaking permanent impairment arising from chronic pain, which is defined as “An unpleasant sensory and emotional experience associated with actual or potential tissue damage or described in terms of such damage” is excluded under the WorkCover WA Guides to the Evaluation of Permanent Impairment.
One exception to this is complex regional pain syndrome (CRPS). There is a very specific criteria for the diagnosis of CRPS in the workers compensation system. The criteria is set out on page 87 to 89 of the WorkCover WA Guides to the Evaluation of Permanent Impairment.
Assessment of whole person impairment (WPI) in the workers compensation system is conducted by WorkCover WA approved medical specialists (AMS). Your WPI rating is one of the main factors in your CRPS workers compensation payouts. However, not all Approved Medical Specialists are equally experienced in CRPS.
Foyle Legal has extensive experience in working with a network of AMS doctors on CRPS compensation claims. We know the importance of choosing the right AMS for you, and to exclude diagnoses that are similar to CRPS but are not CRPS, such as disuse atrophy, unrecognised general medical problems, somatoform disorders, and factitious disorder.
Injured workers who have CRPS will often overcome the not less than 15% threshold to bring a common law claim against their employer. Depending on your circumstances, electing for common law claim may result in a better workers compensation settlement. However, not all common law claims are free of risk or meet the individual goal of the injured worker.
Foyle Legal can guide you on every step on way to ensure that you receive a fair compensation payouts for CRPS claims in Western Australia.

Insurers often fight CRPS claims harder than other claims, it is because the potential payouts for CRPS claims are higher, and the process of diagnosing CRPS is less straight-forward as it rarely shows up on the scans. The common tactics employed by the insurance companies are:
Foyle Legal has extensive experience fighting for injured workers with CRPS claims. We help our CRPS clients to:
We help CRPS clients to get unbiased medical evidence for a proper diagnosis and prove causation.
With the help of medical and treatment professionals, Foyle Legal helps CRPS compensation clients to prove causation and calculate the appropriate quantum (i.e., compensation payout amount) of your CRPS claim that factors in all the future needs.
We have successfully helped many CRPS compensation clients. We use our experience to make sure your claim is progressed appropriately and does not get delayed by delaying tactics.
CRPS is poorly understood by many medical and treatment doctors. To-date, the treatment options for CRPS have been limited. Foyle Legal supports CRPS compensation clients by alleviating financial burdens associated with the legal costs for running the CRPS compensation claim and sharing treatment information based on working with many CRPS clients.
Because the insurers tend to fight hard against CRPS claims, it usually takes longer to reach a CRPS settlement. Our No Win No Fee solution is aimed to provide injured workers with financial relief associated with the legal costs so that you can focus on getting the best compensation payout for CRPS claims as opposite to the legal costs.
CRPS can be a life-long condition, and effective treatment can make a big difference in the quality of life.
Many our CRPS clients have exhausted traditional treatment options and have not received an expected outcome. As a result, many of our CRPS clients have turned to latest treatments that are not currently available in Australia. These treatments have variable levels of success. If required, we are happy to act as a sounding board for CRPS clients with information we learnt from clients with similar conditions.
Please be aware that we are not treatment specialists, and what we learnt from other clients’ CRPS treatment may not work on you. Our learning on CRPS treatments should not relied on as treatment advice.

This section provides an overview of Complex Regional Pain Syndrome (CRPS) and CRPS claims. We discuss what RSD/CRPS is, signs that you may be suffering from this chronic pain condition following a work injury, how the condition is diagnosed and treated, and what workers compensation benefits you may receive for your condition.
CRPS compensation calculator is not accurate. If you have made a compensation claim then contact Foyle Legal for an obligation free review. Foyle Legal have negotiated hundreds of Western Australian workers compensation settlements which help to provide financial security for injured people. We can do the same for you on a no win no fee basis.
Usual Treatment for Complex Regional Pain Syndrome
CRPS is a serious condition with known no cure. Foyle Legal has seen clients who do recover but so far there seems to be very little similarity between the people who have recovered. If you have CRPS you should get high quality medical treatment right away. If your CRPS is severe, you may never return to work.
The most enduring quality of CRPS is that the pain levels reported by the injured person seems out of proportion to the degree of severity of the original injury. If left untreated the injury may get worse over time. Multi-modal treatment is usually required which includes:
The diagnosis of CRPS has been divided into two separate diagnosis:
This type of CRPS arises from an injury to tissues other than nerve tissue. For example, a bone fracture may lead to CRPS in the soft tissues surrounding the site of the break.
This type of CRPS arises from an injury that damages nerve tissue.
Foyle Legal’s experience is that Type 1 is more common. For example it could arise from a broken leg or a broken toe, but Type 2 is not uncommon and can result from a nerve injury such as the nerves in a hand.
How Does complex regional pain syndrome Present After a Work Injury?
If you believe you have CRPS you should seek medical advice. The following are a list of symptoms that Foyle Legal have seen to be associated with a diagnosis of CRPS
How Foyle Legal Can Help with a CRPS Injury Claim?
If you have suffered CRPS you may require medical treatment for the rest of your life. The cost can be considerable and pay include doctor appointments, specialist appointments, medications, pain management, modifications to your home and surgery to treat your CRPS condition.
Insurers such as the Insurance Commission of Western Australia (for motor vehicle accident injury claims) and workers compensation insurers will often recognise CRPS as, firstly, a condition where it is difficult to get a diagnosis, and secondly, a potentially expensive condition and will often look to settle the claim for a low sum so as to avoid paying expenses or additional damages in the future.
Foyle Legal can help you navigate the claims process so that you get the maximum amount you can and medical treatment you need to improve your condition. At Foyle Legal we have the experience, skill, and resources to get the job done for you.
